Natalia Fedner Design, LLC offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site.

Certain products may be limited and subject to return only per our policies.

Wearable Art; Condition; As-Is Sale
All products are bespoke, artisanal, and/or wearable art. These items may change over time, including stretching, patina, degradation, or aesthetic evolution. These characteristics are intentional and not defects.

Items may be one-of-a-kind, archival, or previously used in runway shows, fittings, or photoshoots and may show signs of wear.

ALL PRODUCTS ARE SOLD “AS IS” AND “WITH ALL FAULTS,” WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW.

Fit; Acceptance; Notification Window
Customers are responsible for sizing review. Any fit issue must be reported within twenty-four (24) hours of delivery. Failure constitutes acceptance.

If the item was previously tried on, all claims regarding fit and condition are waived.

No Obligation to Alter
We are not obligated to repair, alter, or adjust any garment.

Final Sale
All sales are final except where required by law.

Care and Risk
Customers assume all risks related to wear, cleaning, storage, and handling.

SECTION 6 – BILLING AND ACCOUNT INFORMATION

We may refuse or cancel orders at our discretion. You agree to provide accurate billing information.

SECTION 7 – OPTIONAL TOOLS

Third-party tools are provided “as is” without warranties.

We are not responsible for third-party content or transactions.

• Manufacture or commission similar designs

• Use branding or images commercially without permission

All products and services are provided “as is.”

We are not liable for any damages including loss of profits, data, or product value.

We are not liable for natural changes in wearable art garments over time.

SECTION 14 – INDEMNIFICATION

You agree to indemnify and hold harmless Natalia Fedner Design, LLC from any claims arising from your breach of these Terms.

SECTION 15 – SEVERABILITY

If any provision is unenforceable, the remainder remains valid.

SECTION 16 – TERMINATION

We may terminate access for violations of these Terms.

SECTION 17 – ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and us.

SECTION 18 – GOVERNING LAW

These Terms are governed by the laws of the State of California.

All disputes shall be resolved exclusively in Los Angeles County, California.

SECTION 19 – INTELLECTUAL PROPERTY; USE RESTRICTIONS

All designs, garments, techniques, and materials are proprietary intellectual property.

Purchase grants a limited license for personal use only.

You may not copy, reproduce, reverse engineer, or create derivative works, nor manufacture similar items.

Unauthorized use may result in legal action, including damages and attorneys’ fees.

SECTION 20 – CHARGEBACKS; LIQUIDATED DAMAGES

You agree not to initiate chargebacks except in cases of fraud and must first contact us.

If violated:

• You are in breach

• You must reimburse all damages and costs

You agree, under California Civil Code §1671, to liquidated damages equal to:

• Full purchase price

• Attorneys’ fees and professional costs

• Administrative fee up to 20%

This is a reasonable estimate of harm, not a penalty.

SECTION 21 – CHANGES TO TERMS

We may update these Terms at any time. Continued use constitutes acceptance.
